Dear Friends,
I resigned from the company on 13th july and submitted my withdrawal form 19 and 10C for withdrawal but some misguiding elements has stopped my full and final settlment after resignation as well, I am worried if they can hold my PF withdrawal also by delaying / non submission of the form to the regional PF office in that conditions can I take some legal actions against my company people as they on regular basis harash employees like this.
Pls friends help me with all details regarding this aspect.
and steps to be taken to get my PF.

Dear Mr.Singh,
Do not worry. You can give petition to your nearest PF commissioner. (or) you can routed through your claim forms from the bankers of the company or bank manager of the bank in which you hold a/c. (or) you can send through a notary public, or MLA or MP (or) a District Magistrate (or) a Gazetted officer of Central Government. No body can hold you PF. Make sure your resignation is accepted. If it is not accepted send it through regd. post to your employer a copy of the original resignation, which you sent earlier and a covering letter with that to settle your full and final. If the full and final is not settled with in 15days of time from the date of your posting the letter, you can approach the Asst Commissioner of labour (conciliation) of your area.

Hi Amit,
They are not supposed to stop you full and final settlement. But they have done. Did you get your relieving & Experience letters?
They can't stop your PF withdrawals. If you are working in another company then you can transfer your pf no the new account. Once you resign the company then nobody can stop your PF. Now the relationship is between you and the PF office. Only thing is the employer has to certify on those forms. Even though they wont certify there are different methods as told by Ganesan to withdraw the PF amount.
My advice is to transfer the Existing PF funds to the new account.

As for as the PF is concerned, the exisitng employer can not have the right to stop the settlement, unless legal violation. Since you resigned the job, have you got a proper relieving order?. IF you are employed now, please transfer the PF account to the new account. If not, you want to withdraw the amount in PF, you may prepare the form 19 & Form 10c and the same will be attested by the Bank Manager where you have the account. OR you can submit the applications duly certified by the NOTARY PUBLIC or MLA or MP OR District Magistrate OR a Gazetted officer of Central Government.
Even after submitting the forms duly signed by above manner, if not settled, you can directly contact the RPFC and settle the same.
normally the HR executives will send their pf claim through employer only, in order to maintain cordial relatioships and this will help them for future refrence by other companies.

Hi, Legally your employer has no right to stop your pf. You can approach concern person in the pf local office and take their advise to get your pf amount.

hi all!
i worked for a organisation from june 2006 to feb 2007. where in i was leave without pay from dec to feb 2007. then i was not working anywhere. can i withdraw my pf amount now. kindly guide.

No problem for that,because it is quite difference compare with full and final settlement and what i wann to give the suggestion is with drawl forms 10 c and 19 are to be done by hr and it should be tally by the records from form-3A.

Dear amit,
Full & final & PF withdrawal has nothing to do with eachother if the forms have been submitted to the PF office. Just make sure that your HR dept has submitted the sam to the PF dept. Also don't forget to take receiving from them for the same(for submission to HR dept. as well as from PF office).
This will help you trace your PF status in future.
