I worked in a company for 1.5 years. Now i have joined an other company a competitor in the same field. My old company is refusing me to pay the PF and they are humiliating me everytime i call them. Can i get this PF transferred to my present PF account without even the consent of my previous employer or should i send an legal notice? Please advice.

Hi Divya Your previous company does not have any rite to refuse to pay your pf amount .. it is a statuatory benifit and they are obliged to pay it ....

Dear Ms. Divya,
Did you had any agreement with your previous employer? - Nothing to do with the PF but since you mentioned that you have joined a competitor, I am asking about it.
Irrespective of any circumstance - even if you were removed from the company for a serious misconduct - company can not deny to sign PF transfer application.
Whether your present employer has sent the transfer request signed by you to the PF department? Please ensure.
Yes, if there is an untenable delay, you can certainly take legal action by sending a notice. However I suggest you to check other methods like using your friends in your previous organisation to resolve the issue.

Hi Divya,
for PF Transfer also you required below mentioned details .
Your own previous P.F Account NoLast employer's PF Account No.
Without these two things your new employer can not do further process.
For getting these two things you have to chech your salary slip or contact to HR person of your last company.

If you got these two things
1. Your last company's P.F Account No.( Because every company has their own P.F Account No.)
2. Your P.F Account No.( Mostly it is mentioned in your salary slip)
You can get these two things from your old company. The person who is working on payroll side he/ she is able to provide these information. U can direct contact to them and asked about the details.
Than you have to provide these two things in form No.- 13 & give it to new employer.
They will do furher process.

Dear Divya, you need not to take consent of previous employer for transferring the PF. You just fillup the form no-13 and submit to the concern pf office.All the best. Rajendra Dhande

Was the strength of the company above 20 ?
Did you ever receive a PF account no. ?
Did you ever receive a pay slip wherein the PF no. was mentioned ?
Attach these documents, write a complaint and send it to The Regional Provident Commissioner under Registered Post and UPC stating the facts mark a CC to the Labor Commissioner too.
They have to pay it by their nose provided you have a Valid proof.
If not report the matter to the Vigilance Branch of PFUI and apply for conciliation with the Asst. Labor Commissioner.

Hi Rajendra,
can you let me know without present company' s stamp & sign on form no.13 how can she submittee transfer form to pf office?
And without previous company's PF account no. & her own pf account no. of previous company how present company can do stamp , sign process?
without above details PF office can not do anything in transfer form.
