In my factory the workers who are coming on 15th Aug and those who are not coming, in both the cases paid leave will be given. But those who are coming on 15th they will be benefitted equally with those who are not coming on that day. How this problem can be solved so that one dosen't thinks that the other is getting benefit even not coming to factory that day.

As per the act, national holiday wages to be paid for all employees. If any employee is asked to work on the particular day should be paid twice the wages or a comepnsatory off to be given on some other day. National & festival holiday register to be maintained for all employees and to be shown to the labour inspector at the time of insepction. This is mandotary.

No, it won't be same for those who are working and not working.. because the workers who are working on National Holidays will get thrice of the normal wages and those who are not working, will only get normal wages i.e. present

In my opinion only the employees who are required to qork for essential services are alowed to wrok like maintenance, security . networking , continuous process,etc,etc.
But in such case they are compensated as below:
First since this is paid holiday he will get full salary for that day. Plus he will be eligible to get twice the salary as if he has worked on overtime.
Normally such things are part of the settlement.
Of course in such case legal formalities have to be followed like taking permission, maintaining register , etc.

Beside all these information it is prohibited to run factory on any National Festival Holiday but if management wants to run factory on that day it is necessery to take permission from authority (Labour Officer) and intimate to Labour Inspector of concerning zone for running of factory on National Festival Holiday, if got permission to run then those who not comes on duty simply they got one paid leave but those who comes on duty they receive on paid holiday as well as two days overtime for that day that means three days wages for one day according to The Factory Act, 1948

First you have to declare the name of workers who are working on National Holiday to the Officials of Labour Office, then you will have to pay them Double O.T. for the day as well as the compensatory off.
