Your work is not alotted to employees piece rate wages basis.....
Therefore, after notice period ends he is liable to receive his legal dues even if your work assignment doesnot finished because this is not criteria for reliaving.

Dear Parathsarthi,
I am working as a payroll executive & here not professional HR. Dept. total hr related activity is taking care by Md. & JMD & Account's Dept. when people are doing wrong management don't take any action. They people are belonging to local. I am very frosted here & I want to leave this organization therefore i should my appointment letter. i think management will not give my full & final settlement. Because some of my senior who have not taking his full & final settlement amount & management are harassing them. may be this type of dirty game play by management & I know very well i am belong to a medium family background.if they are not giving my full & final amount then my situation will be mouth & tongue. Because in future i don't get any job. Please suggest me by rule

please donot hold his full and final because legally he is correct and you are worng.if your pending work does not complete for 3 months he will not wait for 3 month.if you will hold his dues he can file a case under payment of wages act.so donot do this.

Hi Alok,
As per the appointment letter stated that need to complete his notice period. If the person completes his notice period, no company has rights to stop his FNF. Its company's or his reporting structure is in the problem, coz the person had time to take all his work profile, make a file of it. But no one did so.
The person completed his duties as per appointment, but company did'nt.
Please rectify the issue and should relieve him.

According to what I understood I can say :
You are not expereinced enough to understand the gravity of HR in your organization. Your Boss are practical people and their interest is to run business and not creat disputes so they take appropriate decision. You have to learn more and mature first to become influential in organization.
DO not leave job and learn first spend time devote your attention to learn and mature read circumstances arround how your boss takes decision in the best interest analyse them and learn..

Every organisations having different ruls related with your topic, in your organisation having work specific appointment letter. Anyways as your organisational ruls you cannot hold stop FNF, better you have take clearence from his concerned department stating that which files, instruments, equipments he has not submitted. Than take a approval on the same by higher management and make summary of their payable or deductable amount, send them a letter for the same if not responded record of everything send the cheque if payable by post.
