I have heard that we can avoid ESI under some special cases for people who are entitled for the same. I am interested to know what are the actions to be taken, if we do not have a subcode in a particular territory. Pls let me know.

hello dear in my view, you could exempt those employees only where the ESI dispencery is not available in the radius of 10 Km from the base station of that employee. regards dhanesh

Somewhere I gathered, " Plz check the sec.87,88 & 91A of ESI Act which deals with application for exemption from provisions of the Act. However, to claim any exemption Company will have to satisfy the govt. that your company has arranged better medical facility/other associated welfare measures for its employees, which is more feasible & convenient to employees than ESI Corporation. " So what has to be done to get to convince govt?

Hi We dont have ESI facility in our company.As ESI authority people say our area of factory is outside the range ( as we dont have any hospital for around 12 kms from our factory) regards Rajeev Dixit

Generally ESI does not cover establishments which are not in the "implemented area" i.e places where ESI facilities are not available nearby. It is also possible to seek exemption from the provisions of the ESI Act in case the organization is providing benefits which are superior to those being provided by ESI. However getting exemption is a very cumbersome process and takes a long time. You need to apply to the Labour Ministry with complete details of the organization, benefits being provided etc. The application is sent to the ESI HQs in New Delhi who consider the issue on case to case basis. Most of the requests are turned down and even where exemption is granted, it is generally for not more than two years initially. Regards, Menon

Dear Mr........... As per my knowledge about ESI those who are drwing less than 10,000/-salary they have to cover under esi but areas which not covered we need to take axcemption from the corporation. If not ESI deduction and paying contribution is mandatory Regards Sulaiman S.A 9986763529

Dear, ESI is only applicable in ESIC coverage you need not worry about ESI diduction but even you diduct it may harm you and your company. And if you want give facility to your employees you can go for WMC (work man compansation) or you can take private insurance like united insurance. if there is no implemented area pls dont diduct from the salary. Hi, ESI is mandatory and you cannot avoid. You may check with the ESI Office whether the area where your factory/office is situated is covered under ESI. If the same is not covered you may opt for Workmen Compensation/Personal Accident /Hospitalisation policy. Thanks & Regards, Sunil
