Hi! Workmen Conpensation is applicable were there is no ESI facilities or Hospital are not available. ESI and Workmen Compention cannot be post together.

The Workmen Compensation Act provides for compensation to workmen who are not covered by ESI Act whereas the ESI Act provides for such benefits including sickness benefit to the dependents of the covered employees. The ESI Act, absolves the liability of the Employer under the Workmen's Compensation Act and Maternity Benefit Act.

Wherever ESI not applicable, WC Act comes into picture. It was mentioned in the WC Act....
ESI is not speaking about this.
My suggestion is better go for a WC Policy. In that there is no need to mention employee names. Suppose 100 employees are working, you can take wc for 100. Incase of any addition or deletion no need to send request.

We can not opt for WC policy in the place of ESI because ESI is enforced and is mandatory in those factories & establishments which employ 10 or 20, as the case may be, drawing salary of not more than Rs 10000. Under WC Act, employer becomes liable when an accident takes place and inorder to cover the risk a policy shall be taken. Even without a policy, if the employer can manage the compensation, he can do without policy. But ESI cannot be opted out.
