Dear Members, Please give me the general idea about the above said subject as I need to follow the Act in my company. Regards Vikas Kumar 09968008206

Dear Vikas,
The workmen compensation act is the act which talks about the compensation to be paid to the employees who are on rolls and met with an accident during the course of his employment in the company.
The employees who are covered under ESI act need not be covered under this act as the ESI will take care of all compensation related risks and payments.
When the individual & organization is not covered under ESI act the Employer is responsible for the payment of compensation to the employee who met with an accident during the course of employment. The compensation to be calculated on the basis of the nature and extent of the injury, the labour commissioner / Dy are the competent authorities in finalization of the compensation amount. The injury is severe like loss of fingure etc / eye sight etc then the compensation will be huge and it will be very difficult for the management to pay that much of huge amount hence normally most of the employer will obtain a policy under WC from any insurance company so that the payment will be made by that company but the management need to pay annual premium and renew regularly.
I believe this data will clear all your doubts

Is it mandetory to mention the work location in WC policy. some of the policy received by us is just mentioned 'all over india' and name of site location dons’t appear. kindly clearify vinay

There may be multiple locations and a general policy may also make sense but it covers the accidents / injury araising out of employment. There is one more policy called as Group personal accident policy which covers 24hrs extended to out side the premises.

Thank you very much, its really help me a lot. I think there is no requirement in our company as all employees are covered under ESIC - PF act. Thanks once again Vikas Kumar

Dear Vikas,
Some of areas not covered under ESI ; due to unavailability of ESI Dispensary .
for those places where ESI is Not Covered , There WC policy is beneficiery from the side of employer , to protect huge expences whenever major accident take place during the course of employment. Some of Insurance co. Like The National assuarance
co, Oriental Insurrance Co. are doing the WC policy . in two way One is With medical Benefit where Premium is more , second ; without medical benefit where only compensation is piad . in this policy premium is less.

The Act is not only applicable to the permanent employees of company but it is applicable to Contractors employees and principal employer is liable to pay compensation in case of any accident to contractor employee.

Dear Mr. Madhukar, I opine that WC is applicable to employees. it is also applicable to regular, contract, casual and all. Thnaks and regards - kameswarao
