Dear Sir,
Greetings. I am Newly joined in a company as HR officer. There are few employees with above 58 years of age. There is no PF & ESI contribution paid for them. But they are doing a hazardous operation and being a driver in our company. May avail the ESI coverage to them without PF enrolment.

For coverage of ESI and EPF, there is no age limit. If the employee is aged more than 58 but coming under the ESI Act due to his salary being less than Rs 21000, he should be registered forthwith. At the same time, if this person is a PF pensioner then you can exclude him from EPF. But if he had no PF with his previous employer, or he was employed in government service or Indian Railways or PSUs and retired and now getting pension from the government, Railways or PSUs concerned, then you should cover him under PF and contribute to PF without contribution to Pension fund.

Thank you for the information.
But the 58 years completed employees has not shown the interest towards the EPF contribution even their salary is below 15000 (they are not previous member in EPF), But the company has the intention to cover them in ESI alone for avoid the losses when they are under the Dangerous process. Is it Legal to cover them under ESI only? If yes, What are all the procedures to avoid the EPF Enrolment.

Since his salary is not more than Rs 15000 and he is not an excluded employee he should be given PF also. There is no way that he can be excluded from the PF. Yes, if his salary (the salary on which you deduct the PF of all other employees, let it be Basic salary or Gross salary) is more than Rs 15000, he can be excluded saying that this is his first employment but his salary exceeds Rs 15000.
