Dear Seniors,
One of my staff member is on maternity leave from Dec 2016, tough she does not cover under ESIC. She has been given maternity leave for 3 months. now as the new bill has passed from parliament that the maternity leave is extended for 24 weeks from 12 weeks can we extend her leaves as she has applied for extension also, she will be on loss of pay but we need to give her benefit of the act.
any information regarding the new bill pass links only with the ESIC but what if a woman is not covered under ESIC and is eligible for maternity benefit under act. Kindly give your valuable suggestion & feedback.

Dear Nancy, The new law has not come into force as on date. As an organization you can always extend the maternity leave of an employee and treat it as leave without pay. I hope this helps you.

Hope you will also intimate to the members of this forum as to from which date the said "New Maternity Law" has been made applicable and its notification number and date.

Dear Member GARGAA,
It is easy to Misunderstand but difficult to understand
Enhancement of Maternity Benefit to 26 weeks under ESI Act is already in force
Whereas, enhancement of Maternity benefit to 26 weeks under The Maternity Benefit Act,1961is pending for Gazette Notification. once Gazette Notification is released,we will know from which date the benefit is enhanced to 26 weeks
.

1. Sir, Ministry of Labour & Employment, Govt. of India, being appropriate Govt. has now enforced the provisions of the Maternity Benefit (Amendment) Act, 2017. Except in respect of "work from home", amendments have been enforced w.e.f. 01/04/2017. In respect of "work from home" amendment has been enforced from 01/07/2017.
2. Copy of said notification is also attached herewith for kind information of seniors and experts in this forum.
