Dear Members, Govt. of Haryana, Labour Department has issued Payment of Wages (Haryana Amendment) Bill 2O16 Copy of which is attached herewith for your perusal. Govt. in its letter sent to Controller Printing & Stationary shown as Haryana Bill of 2016 while the attachment relates to 2018. After going through the attached notification it appears that this is a copy of amendment notification under Payment of Wages Act, 1936 while as per covering letter it is to be considered as bill.
Notification copy shows that after final consideration all the shops & Commercial Establishments of Haryana shall be considered as industrial or other establishment for the purpose of applicability of Payment of Wages Act, 1936 to them.
The main point which is to be seen now is that after the final notification, if it is approved as it is then all of the shops/establishments covered under Punjab Shops & Commercial Establishments Act, 1958 as applicable to the state of Haryana will also come within the preview of Industrial Establishment (Standing Orders) Act, 1946 because of the declaration of shop/establishments as Industrial or Other Establishment under the Payment of Wages Act, 1936. Shop/establishments employing 50 or more workmen will be going to be affected by this bill & if this bill is passed as it is then in that case they will have to apply to the Certifying Officer, Haryana for certification of Standing Orders.

Plz find attached herewith the copy of Haryana Labour Department Govt. gazette notification for your ready reference. Plz. note that by this notification all establishments (Shops & Commercial Establishments) covered under Punjab Shops & Commercial Establishments Act, 1958 would be fully covered under the Payment of Wages Act, 1936 as they have been declared as Industrial or other establishment for the purpose of applicability of Payment of Wages Act, 1936. After declaration of establishments as Industrial or other establishment you will also be covered under Industrial Employment (Standing Orders) Act, 1946 if you are employing 50 or more workmen during the preceding twelve months. If you are employing 50 or more workmen then you will be governed by applicable Model Standing Orders upto a period of six months & thereafter you will be required to have Certified Standing Orders from the area Certifying officer.
