Dear friends, Please send me a ppt or pdf file regarding PF related all details like what is the procedures for getting the PF no for the factory, what is the procedures after joining the employee how we will allot the PF No to the new employees & in how many days the pf no should be allocated to the new joinee.

PROVIDENT FUND

----------------------

The Employees Provident fund and Miscellaneous Provisions Act, 1952 is a social security measure aimed at:

 Promoting and securing the well being of the employees by way of provident fund, family pension and insurance to them.

 Inculcating a habit of saving amongst workers.

 Providing a steady workforce to the employers and

 Assisting the government by providing funds of considerable magnitude for utilization on various projects meant for promoting economic and social development of the country and the well being of its people.

The Act shall apply to :

 every establishment which is a factory

 engaged in any industry mentioned in schedule I of the Act and

 employing 20 or more persons or

 any other establishment employing twenty or more persons or

For the registration the establishment must submit the PF form to regional office of EPF. After the registration EPF organization is issued code number. This code number is used for all further communication to EPF organization.

All employees in such factory or establishment including contract labour, but excluding casual labour and receiving wages up to Rs. 6,500/- per month will be regulated by the provisions of the Act. Trainee and apprentices are also not included in determination of the numerical strength.

CONTRIBUTIONS

Employee may contribute 12 or 10 %, as the case may be, of the basic wages, dearness allowance including the cash value of any food concession and retaining allowance.

Employer will pay @13.61%.

The Break up is as follows.

Filing of returns

 The employer shall within 15 days of the applicability of the Act send the particulars of all branches, departments, owners, occupiers, director, partners or any other person in charge of and responsible for the conduct of business, in form (Return of ownership), in duplicate, to the commissioner.

 In the event of any change, the same too should be intimated within 15 days to the regional commissioner.

 The commissioner shall on receipt of the return of ownership verify the particulars submitted therein and after having been satisfied allot an establishment code No.

 This code shall be mentioned on all forms, challans , statements, returns and all future correspondence

 A return in the prescribed form5 in respect of employees qualifying to be members of the fund for the first month during the preceding month shall be filed within 15 days of the close of every month be sent to the CPFC.

 A monthly return of contributions in the prescribed form 6 has to be filed with the commissioner within 25 days of the close of the month.

 Annual return of contributions in form 6 A reflecting the employer and employees contribution in respect of each employee is to be submitted within one month of the close of the period of currency to the commissioner.

I resigned from a company on personal reason after working just a month. As provisioned in my appointment letter I served the company 7 days notice. At the time of joining I filled the PF form, but later at the time resignation that is 3rd week of the month I verbally requested the company not to deduct PF from my salary. But on getting the final statement, I suprised to see that the company has already deducted my PF. When asked about this to HR since I resigned from the company only 3rd week of the month, how it's possible this deduction before receiving my salary as most of the companies calculate the salary of their staff only last of the month or 1st week of the following month. They said my PF deduction had gone along with other staff contributions and they gave me the PF a/c. No. They deducted also gratuity, PT etc. Since the company is not giving any satisfactory answer to any of these deductions, I refused to accept my final settlement and it's in deadlock. Please enlighten me whether what company says is correct, if so, why they cannot provide me with receipt of remittance to PF as proof. In case I accept the salary, then it's difficult for me to claim the PF as the company has to process the papers for cancellation as I am not intending to transfer the PF. If I cancel the PF should there by any problem and conflict with my new assignment. What's the procedure to recover my full salary from the company? Should I look for legal possibilities? If so whom should I approach. Your valuable suggestions are invited

PF not received even after 9 months, I have applied for my PF 9 months back, i have still not received it... I keep asking my previous employee and they tell me that they have sent the requisite forms... but there is not sign of my PF money....they then asked me to re-apply but even then I have not received my PF I just do not know what to do... even the PF website is not working.. I am at my wits end..
ANYONE KNOWS WHAT SHOULD I DO....????

My question is:
I was working with a company till November 2012 and was a part of the PF scheme. After that till March 15, 2013 I was running my own business. Now I have got a job and joining a company again. My questions are:
1. Can I withdraw the amount of PF from the previous employer?
2. Can I opt for not being a part of the PF Scheme during my new employment?
