In the absence of proper nomination by wife, at the time of employment, and since employee is no more, it is always better ask the husband to get the Legal heir certificate, and file the claim form. While settling the PF and Pension claim PF authorities will insist for such certificate.

The claim has to file by the legal heir in claim Form-20 for PF amount, for pension in Form-10-D and Form - 5 IF (EDLI). Employees death case use the Composite Claim Form. The following documents to be attached with calim form bank details of the calimant, death certificate of employee, legal heir certifcate, AADHAR etc can be sent to RPFC under the signature of the employer.

You are right, the EDLI is not applicable as she was not in service. Tehesildar is the authority to issue Legal heir certificate.
