My employer has terminated my job without giving proper intimation and reason.The reason they have said to me that i was poor performance and inability to meet targets. I joined this firm on 3rd March 2014. I got my 1st month salary (for march 2014 month salary) on 15th April 2014. But on 15th May 2014, suddenly my employer informed me about my termination telling above reasons. Same time my employer gave me false assurance that they deposited my April 2014 month salary to my account and next 15 days salary i.e. from may 1st to may 15th 2014 i'll get next month. But i didnt get my salary. I didnt get any termination letter also. Daily i am messaging and mailing my employer about my due salary but each time they giving me false assurance that they will deposit my salary.

As far as my performance is concerned, i am SEO (internet marketing executive). My performance is based on website performance. We suggest certain changes to our client. I mailed my employer many times about this. But my employer didnt did anything. How can they judge my performance ? even my employer is also equally responsible. I have offer letter. Salary slip for 1st month salary. (1st month salary is deposited to my account). Please advice what should I do in this case. Can I file a complaint ?

Contact your employer in writing by sending him another letter/mail stating that your past oral and written reminders have fallen on deaf ears. You are entitled to wages for the period worked and that you have been illegally been dismissed without being warned or spoken to and without giving you a chance to reply to allegations of non performance etc.. Dismissal from employment is based on the terms in offer letter so you will know better how to word the letter accordingly. Claim your outstanding wages and for unfair dismissal without being given a chance to reply. Tell them that if your letter remains unanswered or dues not paid within reasonable time (say 15 days) you may have to seek legal recourse at the cost of the company.
Then prepare to fight it out by hiring legal help. Whatever you do your preparedness to take this issue to logical conclusion is the key. So roll this in your mind and act accordingly.
