I want to clarify few confusion,please help me out in this.
In our organization we have a leave structure as:
0- 6 months Probationary Period Leave Allotted - 3 Sick leave
6 months -1 year - 12 leaves (CL+SL)
1-2 Year 12 (Cl+SL) + 12 Earned Leaves.
Now my query is whether that 1- 2 year span is calculated including the probationary period or after completion of probationary period the tenure starts of 1 -2 year.
If so then how can I calculate the allocation of leave of every employees joining in the middle of the month(Our leave Year is from April to March).
I need this to be sloved ASAP, please can anyone help me in an urgent basis.

The policy itself is wrong. You should have a policy that after completion of every month how many CL, SL ( if he is not covered under ESI ) need to be allocated. However for every completed 20 actual wsorking days there should be one EL and this need to be credited to the employee account on the 1st of January every year and you cannot have the system with out EL for 2 years this is against the law (either Factories act / shops and establishments act ). In all organizations year for the leave period will be 1st Jan to 31st Dec., if the people joins in between the leave eligibility will be proportionate. For all practical purposes the probationary period also includes for service. In some of the organizations Trainees are eligible for special leave. Pl. discuss with the management and change accordignly

First of all as mentioned above you need to let us know whether you come under factories act or Shop act and whether these are workmen under ESI or not. The laws are different for both.
I am assuming they are executive or staff level employees in which case you can say that the leave for the previous year or the year 1 - 12 mts has lapsed...but put it down in a policy somewhere and keep it for reference. 24 days a year is fine..leave cycle from April to March is also fine if they are non workers.

Dear Chatterjee,
If your organisation comes under the shops & establishment Act, then you are required to follow your state leave rules.
Leave is been calculated on pro-rata basis, if you have 12 SL for a year and somebody joins in june month then he shall be eligible only for 10 SL for that year. The same will be applied for other leaves as well.

after probation, employee will be entitled for leaves after completion of 1 years services.
for every 10 days working he will be allocated one leave. Means for a month 2.5 leaves. For past completed year, he will entitled to take 30 leaves (22EL+8CL)
All the leaves, organization give to employees, is based on the present days of that employee in last calendar year.
This way, you can manage your show.

As per your reply, i understood that one can encash their ELs after the completion of year (if the company is following Jan to Dec Yr. then it is 1st of January every year) or else one can accumulate up to maximum no. of ELs as per their state leaves act.
my query is 'is there any rule of minimum ELs in hand before encashing previous year total ELs as per the Factories/Shops & Establishment Act? if yes how many?

Every organisation is having a leave policy. As per the leave rules from the date of joining (Trainee / Probation / Confirmed ) employees are eligible for leave. The leaves as follows CL-12,SL-12,& EL's-15. CL & SL is applicable to all employees, if the people joins during the calender year the leave will be calculated on prorate bases. EL's is applicable for probation staff after completion of one year service with 240 days working. The trainees is eligible after completing their training period.

1) 6 Casual Leaves for all employees either they are on probation period or permanent employee. An employee can avail .5 Leave /Month on full pay.
2) 6 Sick Leaves - On full pay for all permanent and probationers, credited on pro-rata basis.
3) 15 Earned Leaves- Only for permanenet Employees. Employee can avail 1 EL/ month. Credited on pro-rata basis.
8 Holidays for every one like New Year,26 January,Holi , Diwali,I5 August, 2 October,Dusshera,X mas
