We are running ATM machines with unmanned kiosk concept (ie without human being / zero employee) within the Jurisdiction of Gram Panchayat where in S&E is not applicable or Municipal Authority is unable to issue licenses under Shop & Establishment Act.
Is it Gram Panchayat NOC is mandatory for running ATM machine.
Please guide...

For running nay business (even if you say that it is run for charity and not for profit) licence from the Local authority (Gram Panchayat/ Munipality/ Corporation) is required. When you run an ATM counter/ kiosk, the thing is not different. You should take permission to operate an ATM from the local administration. Since for the local administration who runs the ATM whether it is run directly by the bank or is it through somebody else is not an issue, the responsibility to take the licence may be with the bank.
It is not the Municipal authorities who will issue licence under the Shops and Commercial Establishments Act but it is the Labour Department who will issue this certificate.
