Dear Sir/Ma'am, I am EX employee of xyz bank.Due to my mother illness i was halted at kolkata for month of november 2022 and not able to join bank. I have already informed my senior authority over mail . Also I put my resignation through mail to HR, senior authorities, But in between they send letter that I am taken leave with out any information. After this I also send mail. I have received a termination letter for absconding as voluntary abandonment of service for long period of leave with out intimation/informing

They did not provide any relieving letter , they already said. I am working only 3 month (provisional period)

Kindly guide how can i get relieving letter.

Sorry to know about your case.

You took one month leave and then emailed resignation and subsequently received termination.

Few questions :

If your leave requirement is for one month you could have asked for a break-in-service without pay?

Even if was not in a position to continue you should have served notice period or requested for pay in lieu of notice period.

Just emailing resignation letter and expecting employer to issue relieving letter is not making sense.

Being a employee of a Bank you should have been vested with some responsibilities. So how employer will handle if you choose not to continue all of a sudden.

Now the only option is to request with Bank for proper relieving by paying money in lieu of money. Alternatively you can show your Mother's medical document and prove your case as a genuine one.

1. There was so much non justifiable presure . I want to resign for this job. In the mean time my mother health issue come and I took 4days leave after that I give a mail that I am unable to continue the job to HR, branch manager , My senior head.

2. I am mentioning all the thik that I could not serve notice period due to my mother was heart patient and I am the only son. I am also agree to pay any amount in that regards.

3.I am just only join 2month , is that the right way to talk an employee that ur not in permanent , I will kick out any time ? Is that the right way of talking just 2month employee?.

I have valid reason and also give the proper document tation.

I also got the termination letter, is that can I request the relieving letter?

Hi

It looks like some conflict is already exist between you and your employer and your employer utilized the opportunity. Seems some heated arguments took place already..

Now the option before you is

If the period of employment is very short and no pf deducted then forget what had happened and remove this experience from your profile.

But if pf deduction was there then future employer might catch you the UAN and in case of BGV your employer will give you negative feedback.

So instead of analysing who is right or wrong look for amicable solution for the betterment of your future. If you have plan of proceeding legally your Employer will defend it easily. So please take a call.

Period is short but pf deducted for 2 month so that the UAN show that. And also One of new employer BGV and received the nagative report .

What is the legal procedure? Is that I am call my HR in this regards ? Is they fully denied to give my relieving letter then what is the next process ? How could I get this ?

In between I remove my experience in my profile but the UAN show that. Kindly help. So much difficulty face only for just 2mont I am worked before another NBFC SINCE 2013.I have all the relieving document in my previous organisation. Kindly help me to get out of this situation.

Hi

My sincere suggestion is go for compromise. You may get different suggestions from other members. But through mutual discussion arrive at some solution. For the employer they will go to any extend to safeguard their interest but as a individual to what level you will be able to spend time and money? So just think about it.
