I would like to know gratuity eligibilty, I need to complete 4 yrs and 8 months or 240 days. The 240 days including Saturday and Sunday or working days 240. Could you please clarify. I have joined in company on 16th March 2011 and when can I eligible for gratuity. Regards. Pranab

As per Gratuity Act, minimum service to get gratuity is 5 years. If you are in service, better continue till 15.03.2016 to confirm your eligibility.5 years completion in PF also will help you to get exempted from paying Income Tax.

Act says workmen has to put 5 years of continuous service in order to eligible for gratuity, in each years you have to work for 240 days which include EL, Maternity leave, Leave due to accident and medical leave.As Mr.Abbas says finish 5 years of service for safer side.
