If the employer is okay with it, please pay. No rule restricts any benefit to an employee. If you are so generous you should treat the leave for two or three months on medical ground as paid leave.

Hello,
Your question is open ended you should have to clearly mention that what was the reason for your leave.
Further...There is no such law for the restriction of Employee Welfare. It is totally depend on your employer if they are ok with it they can release accordingly.
If the related reason was health and you are taking medical treatment from ESIC then you can take Sickness Benefit from ESIC.

Dear Citehr Member Hr-Pratyancha-Financial,
The query raised by you has to be considered with reference to Leave Rules/Policy of your company. Medical Leave is admissible to employees of all establishments. If the Leave Rules/Policy do not have provisions for Medical Leave, then such leave has to be considered keeping in view the nature of illness and genuineness of medical certificate. The Employer can grant any amount of leave at its sole discretion. Kindly ensure that the Leave Policy/Rules have a provision for Medical Leave. At the same time it has been also correctly stated by our Expert that ESIC Sickness Benefit can be claimed by the employee if your establishment is ESIC compliant.
If you desire you can get your leave policy/rules vetted from us.
