Dear Seniors, What is the maximum limit for overtime (no. of hrs) under the contract labour act? And I had gone through the contract labor act, but it doesn't specify the number of hrs(maximum). And also I would like to seek your clarification that if contract worker is getting overtime wages more than the monthly wages, is that a good sign to principal employer. Please help me in this regard.

Dear Ratna Under General Standard section 7 (a) Wage & Hour Division it is 40 hours , the maximum limit of overtime in a week . Regards Shubham

law for max limit for overtime hours is same as for factory workers.
they are allowed max 12 hours in a week and 50 hrs in quarter as per factory act.
the question which you have asked that contractor worker is getting ot wages more than monthly wages is not a good sign because it indicates that contractor worker are working more than 12 hrs per day.

employee working under contract are covered factories act also.it means all provision of factory act is applied to contract worker if he is working in factory.
as per factories act worker means a person employed,directly or by or through any agency(inclding a contactor)with or without the knowledge of principle employer-----
so dear all factory act provision will apply to contract worker also if the deployed in factory ,if he is deployed in any other establishment than shop act provision will also apply.

The overtime payment is regulated by Factories Act 1948 and not Contract Labour Aact. The later only tells about regulation and abolishion. Dont get confused.:-? PL read Factories act -Daily working hrs.

I want to know can run the factory through 100% contract labour , all operation , manfcaturing ( means all activities) , If yes suggest , if no , pls provide the suggestion as well aif any case law

basically you can not hire 100% contract labour becasue you will not get licence.for manufacturing process contract labour is not allowed.it is allowed for intermitent and casual nature of work.manufactring process is regular work ,so contract labour can not be used for that purpose.
that is the reason we get licence for contract labour for loading unloading,house keeping etc

Respected Malik sir,
As per your comment on overtime, the overtime limt shohld be 12 hrs per week or 12 hrs per day. Because there is a restriction of 9 hrs working in a day. If we calculate 48 hours restriction of per week and deducted 60 hrs limit of per week working it remains 12 hrs per week means you can work only 2hrs extra per day.
Is my calculations are right or is there any other way.

dear vinay you are absolutely right it is 12 hour per week a employee can work 60 hrs per week only so sixty minus forty ,it comes 12 hrs as ot in a week. tks j s malik
