Dear All, One of our employees is completing her maternity leave benefits, and now she wants to join back with a half-day work-from-home option by doing compromise on salary for 2-3 months.

Please confirm if we can pay half salary to such cases as all her statutory things like PF will be contributed on lower salary and even we cannot lower the basic salary.
Need your guidance on below
1. Is such arrangement is allowed statutorily or not
2. How to manage statutory benefits as it will be half day salary
3. In case we can permit then what are the precautions we have to take

Hi,

If it is mutually agreed between employee and employer then I don't think there will be any issue statutory wise. But better take a request letter from the employee stating that it is her own call and not out of compulsion from employer. If possible encourage the employee to support from home on full time basis say minimum for 7-8 hrs. During future PF claims these NCP days might be queried by PF authorities.

Also please note that even after completing 182 days of maternity leave period, if need be, based on physical conditions, employee have the option of extending the leave with pay for another one month provided if she submits proper medical proof supported by a gynecologist's certificate.
