Section 42(1) of the Act says, no employee's contribution shall be payable whose avg. daily wage during wage period falls below the wage prescribed by Central Govt.
According to Central Rule 52, the avg. daily wage for exemption of payment of employee contribution under Section 42(1) is Rs. 70/-. Such employee is an "exempted employee" under section 2(10).
According to Section 42(2), both contributions are payable by employer.
If there is any amendment to above, one can draw my attention. Value addition is welcome.
