What salary is taken into consideration when deduction is done for excess leaves? Basic salary or Gross Salary?
Is there any rule regarding this for a Private Limited company registered in New Delhi India?

Leave without pay (LWP) deduction should be counted/calculated on gross salary only untill or unless it is specified to be deducted on Basic Salary.

Dear friend,
The general understanding is that for LWP purposes the salary (gross) would mean, the salary what the employee would have drawn had he not gone on leave. Further, this will not include incentives, OT etc. which he would have earned by working. In short, Basic, DA, HRA, and other allowances paid on monthly basis for the days he would have worked.

The question of making salary for excess Leave does not arise. It has to be treated as Loss of Pay/Absence.
While calculating Salary, all Components which are part of Monthly Salary have to be taken in to Consideration based on Salary payable Days.
Annual Benefits should be paid on Prorata basis
