If an employee leaves the company without informing us or without NOC, can we hold his salary? What kind of legal case can the employee file against our company ?

Generally, any employee is expected to give proper notice, serve the notice period and get necessary No Due clearance from all concerned only should leave the organization. However, in case an employee is absconded and the management, even after taking all reasonable efforts to trave him out, could not find out his whereabouts, then, the Management can hold the full and final settlement of such employee. If at all he raise any claim for the same, you can very well advice him to come and get relieved appropriately after handing over the company's properties, if any, in his possession. Nothing wrong in that in my opinion.
