what if employee join the company with more than 5 yrs of experience or 4 yrs of experience ,let me know the gratuity process in below both the scenarios
1) he has received the gratuity from the previous employer
2) he has not received the gratuity from the previous employer
how to calculate in such cases and when current employer should pay the gratuity to such employee.

Dear Madam,
It is surprising that you approach this forum without making any effort yourself of reading and understanding relevant provisions in the Gratuity Act.
Any employee, irrespective of any number of years' past service joining you, you are not liable to pay gratuity for past service in any other organization. Had you taken trouble to read the provisions you would have got enlightened on this.

Appreciate the above suggestion. It is an advice for HR especially young professionals to be aware of basic knowledge and features of subjects concerned. Certainly, seniors in this forum will give appropriate advice on all related issues, but when some are looking for spoon feeding type answers, it is not justified. Youngsters should learn and grow and should not depend for support all the time. Need to understand crutches cannot take us too long unless we attempt to stand on our own legs first.

Dear Miss Vaishali, The question of Payment of Gratuity is in respect of Service rendered in your Establishment.
As per your illustration Employee in question has received Gratuity from his First Employment consequent to putting 5 Years Service.Similarly in his Second Employment, he has not received Gratuity because he has put in only 4 Years Service
Your liability of Payment of Gratuity arises consequent to completion of 5 Years of Service in your Establishment
