Payment of Gratuity (Amendment) Bill, 2010
The Payment of Gratuity (Amendment) Bill, 2010 has been introduced in the Lok Sabha. The Payment of Gratuity Act 1972 provides for the payment of gratuity to employees engaged in industries including mines, oilfields, plantations, shops, factories, amongst others. This Amendment Bill proposes to raise the ceiling of gratuity to be paid from the present level of Rs. 3.5 lakh to Rs. 10 lakh.

Dear All,
We recently had an employee retire from the company after completing 30 years of service. Regarding his gratuity, the full basic and DA were taken into consideration and calculated accordingly. However, at the time of payment, our corporate office deducted Rs. 10,000 from Rs. 6.29 lakhs towards tax. The employee is disputing this deduction, stating that gratuity is exempt from tax up to Rs. 10,00,000. Please shed some light on this matter.

Dear Praveen, we are required to abide by the law relating to the Payment of Gratuity, and hence we are not in a position to opt for an amount less than the prescribed maximum limit of Rs. 10 Lakhs.
