In my opinion, you should approach Prescribed Authority under Payment of Wages Act 1936 which is generally Assistant/Deputy Labour Commissioner of the area. There is provision of upto 10 times compensation under the Act 1936, whereas, if you approach Labour Court u/s 33C(2) of the Industrial Disputes Act, there is no provision of compensation.
