Dear All, I manage a LLP firm and I would like to know the labour laws that are applicable to a LLP firm. Can someone help with the labour law details? Thank you in anticipation!

There is no separate labour law for LLP firms. All labour laws applicable to other companies, whether they are unlimited liability partnership, sole proprietary firm, private limited company or public limited company, are applicable to your Limited Liability partnership also. Labour law are made applicable not according to the constitution of the company, but on the basis of number of workers employed and the nature of business carried out, like manufacturing, mining, trading etc. Therefore, if you employ 10 persons whether directly or through contractor, whether for a day or for a long term, whether casually or permanently, you are covered by ESI Act, and EPF & MP Act (though at present it is 20 employees). If you run a factory you are covered by Payment of Bonus Act and Payment of Gratuity Act. You are covered by these Acts provided you employ 20 or more in an establishment other than factory. You are also covered by Minimum Wages Act which tells you what should be the lowest wages below which you should not pay wages. You have to comply with the requirements of Payment of Wages Act as to when should you disburse wages and in which form. In case you employ 50 or more, you are expected to frame a standard procedures to be called Standing Orders. There are guidelines in the Industrial Disputes Act how can you declare lay off, or retrench employees. In general, all laws applicable to a factory or commercial establishment will be applicable to you also.
