Dear Seniors,
Will Maternity Leave be considered as working for the purpose of following-
1. Calculation of PL/EL for the period of 12 weeks maternity leave. Will full 15 PLs be allowed in such a case or reduced for 12 weeks duration of maternity leave?
2. Calculation of Bonus for the period of 12 weeks maternity leave.

ML is not considered as leave. It is a benefit irrespective of actual physical absence from duties. Pon

Dear Vikas,
1. According to section 79 of the Factories Act, 1948 maternity leaves for any number of days not exceeding twelve weeks shall be deemed to be days on which the worker has worked in a factory for the purposes of computation of the period of 240 days or more but the female worker shall not earn for these days.
2. Bonus is payable on the amount of maternity leaves.

1. Are you under the Factories Act or what act ? 2. The employee covered under ESI ? 3. Did she actually availed the leave or it is nodal case ? kumar.s.

As per Bonus act if an employeed worked more than 30 days , then he is liable to get the bonus fro the finincial year.& Maternity leaves date to be cancelled from the said leaves.
The same principal applicable for calculating the leves for a calendor year.

Dear Vikas,
ML are considered as working days as rightly said by Mr. Khola. It has to be treated in the same way as Privileged Leave, which is considered as working day for all purposes.
