Is this 12 hours is spread over timings of a shift or these are the actual working hours ? We are required to examine the applicability of the Act udder which our working hours are regulated & then go through that Act to see the shift timings, actual working hours & rest interval timings.

As per the Factories Act 1948, maximum working hours including break should not be more than 10 hrs and 30 minutes in a day, out of which maximum working hours per day stipulated as 9 hrs and per week as 48 days.
There should not be any discrimination among the skilled and unskilled workers.

Dear Friend, Twelve Hours Work in a day is neither legal in commercial establishments nor in factories in India. regds anil kaushik

Let it be any industry, Working hours should not exceed more than 48 hrs in a week and 9 hours in a day. If it exceeds the workmen must be paid with double Over Time Wages.
But in factories in Gujarat, Government itself restricting for allowing Overtime work.

dear friend, according factory act. time of working hour is 8 but it can extendable by giving notice/information to labour office.

What is the rule on the software companies, that make employees stretch beyond 8 hrs.. A reason of inefficiency is cited in most cases.. Can the employee still take up the issue with HR if the manager forces the employee to work beyond 9 hrs citing emergency problems?
