Hi Malathy, Employee’s salary is not the criteria for paying OT,neither you can deny on that clause. What is the designation of the employee you are speaking? What is his responsibility?

HI,
Please understand, as rightly said by Mr. Venkata salary is not criteria for any employee to calculate overtime. It is applicable to all employees defined or specified as employee under law. Secondly, if you have any long term agreement with union then you may have the option to convert overtime to compensatory off but it should be part of your agreement and standing order as well.

Dear Malathy : Payment of Overtime wages is a statutory necessity under the Factories Act 1948 and the coverage under the Act extends to all who are directly or indirectly employed in the factory including the premises (Section 2 m). There is no salary criteria in Factories Act.
