Hello Team,
Please anyone can suggest my below question.
As of I resigned from my last company and company has also provided me releiving letter,besides they have already recoverd my leave encashment,notice period of three months and last day's salary.now when I asked my employeer to pay my Gratuity and PF amount he told me that even this would recover from your side.where I have only mentioned in my resignation that " cover Notice Period from F&F) nothing else.please anyone can suggest me is really PF and Gratuity recovered from F&F after recovering my all the amount against notice period,Leaves and last 10 days Salary.please suggest me where I can reply to my Employeer accordingly.

Dear Kajal,
As far as notice period is concern employer has a rights to recover from your full & final settlement but no employer has authority to recover your PF Claim amount & gratuity amount from your F&F.

Legally there is no such thing called recovery of gratuity. PF, ESI, PF , IT and statutory recoveries can be made from salary.

Hello Vineet,
Thankyou so much,also please if you can suggest me one more thing if I have done my exit formalities where I did not have any company dues pending on me also I had never applied for any type of loan and other financial things,still company can recover my PF amount? If no according to law then what step I should take if my employer has given me a false reason.

I did not give a prior notice period but my resignation was accepted by employer and he gave me relieving letter same when I left.
