If your employment contract is signed in India and the transfer to US was as per requirements of the company, you are eligible to get gratuity as per Payment of Gratuity Act, on your termination of employment. Accordingly you will be getting 15 days statutory salary (Basic +DA, if applicable) for every year of service and fraction of service above six months, subject to a maximum of Rs 10 lakhs.

Yes you are definitely eligible for the gratuity. Ensure that your company gives you the gratuity that you deserve. Also instead of coming back try getting a new job there. Update your CV, get cover letter writers for hire to make you a winning cover letter and apply for a new job. Don't let your travelling time go to waste.
