Hi Friends,

Need your inputs quickly on following case:

  • Employee 'X' was on approved leave till 18th May 2008. And, he didn’t report to office after that. Company initiated the absconding process for him w.e.f. 22nd May 2008 and sent him first letter to the same effect on this date, asking him to report to office.The second letter was sent on 28th May 2008.
  • And as per their policy & process they had sent him final letter, informing him about his termination on 16th June 2008 (after one month). In this letter they have mentioned that his services are being terminated w.e.f 19th May 2008. They did that since their absconding policy states that they have to inform employee about his termination after 1 month of his ‘unauthorized absence’ however there’s nothing mentioned regarding the last working day that has to be considered in such case in their policy.
Would like to ask you that in such what should be considered as his last working day either 19th May 2008 (next day after his approved leave) or 16th June 2008 (one month from his unauthorized absence).

Also, since all absconding letters are dated post 19th May 2008 which is already his termination date then does those letter hold any value in this case.

Kindly repond at earliest.

In our company, according to the absconding policy, the date of termination is the last letter when sent to that particular employee. ie.e if you are sending final intimation on 16th june'08, that he had not reported till that date then the particular employee should be terminated from 16th June'08 and not from tha 19th may.
