--Difference between Domestic Inquiry & Internal Committee Inquiry”--

1. I Cs’ are Permanent Legal Body; Domestic Inquiry Officer/Committee work on ad hoc basis;

2. Inquiry by I C must be concluded in 90 Days; Domestic Inquiry must be concluded in 180 Days & in certain rarest Cases within 365 Days as Ruled by Supreme Court;

3. ICs’ Members are Nominated to serve for up to 3 Years; Domestic Inquiry Officer/Committee serve only till Inquiry is over;

4. I Cs’ have Powers of Civil Courts, Domestic Inquiry Officer/Committee are given No such Powers of Civil Courts;

5. ICs’ comprise of 4 Members, Domestic Inquiry Officer is Single Person and Inquiry Committee often consist of 2 Members;

6. ICs’ must have a Woman Employee at Senior Level as IC Presiding Officer; No such compulsion for Inquiry Officer/Committee;

7. 50% of IC Members must be Women-Employees; No such Provision for Inquiry Officer/Committees;

8. ICs’ Findings are Final & Binding on Employers; Not same for Inquiry Officer/Committee;

9. ICs’ empowered to Determine & Recommend Compensation claimed by Aggrieved Women; No such Power for Inquiry Officer/Committee;

10. ICs’ can initiate Conciliation at the behest of Aggrieved-Women only; Inquiry Officer/Committee has No Authority to Conciliate;

11. ICs’ must File IC Annual Report for Calendar Year before District Officer; No such requirement for Inquiry Officer/Committee;

12. ICs’ are empowered to Recommend Deployment elsewhere of Aggrieved Employee or Respondent during ongoing Inquiry; No such Authority to Inquiry Officer/Committee;
