I want to know, what is the liablily on emplyer fro her.

its a complete moral responsibility of employer to take care of her interests in the time of need.
all other employees can also accumulate funds for her medical expense and faster recovery with the help of best medical attention.
But main responsibility comes on to employer to take care untill she resumes the office..

i am agree with Mr. pankaj. but according to ESIC new ammedment regarding wages ceeling 10000 to 15000 effected from May-10 you have to fill the declaration form the employee and send it to local offices for his temprory card and submit the accident report to local esi office. by this you can claim for benifit of leave etc.

Dear your employee is YOUR responsibility. Dont look for ESI or other factors. Just go to your employee and assure her that she need not worry and company will take care. This will create positive image of your company and as HR it is your responsibility. In our company a labour met with an accident (contract for a month) and he was air lifted to Mumbai for treatment and taken well care off for 23 days and brought back. This cost the company more than 10 lacs rupees, but the employees and the contract staff feel secured and safe here.
At this time your employee is under pressure and may be feeling low - go ahead & console her - That what I personally think. Other may differ - its their opinion.

I agree with Mr. Neeraj Dubey in this context. The first and foremost important thing in cases of accident is get them the best possible medical attention immediately without hasitating / wasting time about eligiblity or responsibility. Once the injured is stabilised, then being in HR, you will be having lot of options based on the criterial like ESIC, Group Mediclaim, GTA, Contributions from employees and Management etc. etc.,,.
Lesson learnt _ propose good welfare schemes to employees in the organisation which will come to our rescue in emergencies like this, which will create the sense of belongingness.

Being in HR its your first and foremost reponsibility is to look after the welfare of the employees. And now its your time to look the things like is she getting good medical attention or not and whatever the matters is related to ESI, group insurance you can adjust these things after she is cured and returns back to the company.

First moral responsibility is take care of employee what laws say is immaterial,
Next, This is clear cut incidence of "Notional Extension Theory" where employer responsibility starts from the moment an employee leaves his house gate to his work place directly and reaches back home from his work place to home directly.(He/she cannot diviate on other personal work ). It is considered as on duty even if he has not reported duty.

If you have failed in your primary duty, it becomes your moral duty to rush to her help instead of rushing to this site and seeking for loop holes and escape root.

Morally, as soon as any employee leaves his home to join his assigned duty, it becomes the responsibility of the employer to take care of the employee if he meets an accident.
Also, I believe there are cases finalised in the court, that an employee is considered to be on duty as soon as he leaves home for his work at the normal time he usually leaves for work daily.
I have known Co's to take care of employees who met with accicdents when they left home to report for duty on the very first day of his joining as per appointment letter. As per law, the candidate may not have been an employee as he was yet to get his appointment formalities completed.
In all such cases, extend help first and worry about who is to bear the cost later.
Human relations come before anything else.
