Hi All, Could anyone help me to get the details and policies to know about the Gratuity calculation procedure?
I had worked for the company for 8 years as a full-time employee and then later on due to personal problems I had converted as a part-time employee and served for another 1 year. So my salary also has been revised by 50%. Since I am eligible for Gratuity now, what would be the calculation.
I appreciate it if anyone can forward me an appropriate link to see the government policies to see the calculations.

Gratuity is calculated on the amount of salary that the employee draws at the time of his leaving the company. Therefore, you will get gratuity for the entire period but the amount will be calculated on the present salary only.

Isn’t this injustice to the employee? What if the case was from part time to full time?

Dear colleague,

What Mr Madhu TK has stated is a correct legal position as regards the calculation of gratuity on the last salary at the time of leaving.

However, since your longer chunk of service is a full time and last one year is only part-time, you may request the company to revisit to calculate separately for eight years' stint and one year part- time stint. If they accept, well and good, otherwise, though unfair, will have to live with the law.
