Hi Experts,
Was working with a Private Limited Company, as Financial analyst and Adviser, Recently have left the organisation with the Prior notice to its CEO and director and the same has been accepted and provide relieving and experience letter. Have cleared my Notice period too.
Now i had few OS receivables from last one and half year salary.
Company was under loss, and it ws not able to pay salary to its employees, having bullish eye on the growth of our career i was working, but finally due to financial pressure i resigned. Now after resigning the CEO is denying to pay the dues without any reasons.
But the payables are recorded in the company financials.
Kindly advise, How can i recover my OS Salary??

Before giving the relieving and experience letter, the HR needs to do your Full & Final settlement. It would have been an unleashed condition if the amount has been comparitively low at a situation where the company was undergoing a downfall.
Precisely to the issue in not paying salaries hitherto with huge amounts which are at stake to the employees. The company could have remitted smaller amounts to clear the pending amounts when there was a no cash flows available instead of bullying or pressurizing employees thus far.

- Do you have enough proof to substantiate the amount pending?
- If you were sure that employer had any "bullish eye", why haven't you encumbered when you finally decided to leave?

The case goes like this.
1. The amount is large sum.
2. While issuing experience letter, they told that they will release part by part payment
3. Proof: Company pays salary only through bank transfers, and the bank passbook itself stands as the proof. and the same amounts are recorded in the Company financials.
4. Denying means he is asking 4 years time to pay my dues, that too they will pay the dues in 40 installments.
5. I have all the email proofs to prove their obligation.
6. As they are asking 4 years of time, i requested a interest on the OS dues, after that they are wining to pay.
Kindly advise.

If you want YOUR hard-earned money then seek a conciliation officer and speak to him regarding the issue with the pro's & con's sugested by the employer alongside accusations
