Dear HR Fraternity,

Greetings of the Day!!!

I am working in a construction company. The company has changed its name and also applied for new pf number for other state as it has shifted its HO from one state to other state. We need to transfer all the employees from old company to new company having new pf number.

Need your kind suggestion on how to transfer employees from one company to another including their PF & ESIC.

It is a transfer of undertaking. Hope the same is as per the guidelines issued by the government.

On transfer one company (A) gets liquidated and another company (B) will be formed. the employees of the company which is wound up ceases to be the employees. Therefore, you have to mark 'exit' in the EPF portal of A company with reason "Cessation (Short Service" with date of exit. You have to show this employee (each employee, perse) as a new employee in the EPF portal of B Company with next date as the date of joining. The UAN will remain the same but only PF member Id will change. This may be done without delay. The employees, in due course, can log in to their member portal and transfer the PF standing to the credit of A company to B company using the link, "one member one PF" field in the portal.

In the ESI portal of ESI also, you have to marl all the employees who are under ESI as "left" on such date on which the closure has happened. Now you have to register each employee with the same ESI number in the ESI portal of B company. This may be done on priority because registering an employee should not be delayed due to various reasons. Since you are registering them with the same ESI number, the process will not take time because once you tick Yes against the question, is the employee an existing employee, what is to be done is just to give the ESI number and date of joining.
