Hi ,
I am working is private IT concern , recently I have resigned my position and couldn't able to serve the full notice period of organisations due to some unavoidable reason.. my HR is giving me Termination letter and also asking me to pay for notice period .
I want to know on what basis an organisation can terminate individual .is this correct reason .? Please advise

Dear friend,
When the employee fails to fulfill the notice condition already stipulated in the contract of employment for resignation, the resignation will not be accepted by the employer. In such a situation, if the employee walks off the job, it can be construed by the employer as misconduct of abscondence and he is empowered to initiate formal disciplinary action and terminate the employee. But once so terminated, the employer can not demand notice period salary.

Dear Sir,
Thank you very much for you reply . The employer is demanding me two and half months of salary deducting my LTA and PL. If am failed to pay that , I won't be receiving any letter not even Termination letter ..this is response I got from my employer. Please advise me how to handle this and also want to know what is fate of my privilege leave balance , as I have worked for this organisation for more than 3yrs and I have 36 days of PL leave available for deduction .please advise me on this sir..
