The new amendment to the PF & FPF Act madates payment of PF & FPF contribution for foreign Nationals working in India. My question is whether PF & FPF had to be paid for Foreign Nationals who are Directors of the company and draw remuneration in India. If the same foreign national is a director in more than one Indian company and draws remuneration from all the comapnies, should all the companies in which he is a director, deduct & pay PF & FPF for that person.

Yes, any foreigner working in india could be member of PF /EPF as per law, the law has been ammended in last year, but subject to treaty with the coyntry REgards Arun

Dear sir
Small query related to the pf withdrawal of international worker. Basically citizen of Japanese who attain the age of 45 age and held the position of director in Indian Company and resign the org. on 21st oct 14. from pf office we get that will withdraw the pf of concern person only after the attain retirement age i.e.58 because india and japan doesnot have social security agreement.
Please guide me regarding same.

It is okay for an Indian Director because an Indian getting salary of more than Rs 15000 from the beginning can be excluded from PF contribution but for a foreign national this salary ceiling is not applicable. However, there is a technical problem associated with his enrollment. You cannot generate UAN without adhar. Though a foreign national who is in India for at least 182 days can take adhar, the rules of EPF says that one should be enrolled from the day one onwards. Therefore, you have to get this technical issue clarified and proceed.
