Dear Jagdish,

With due respect to your efforts made for us on the The Punjab Shops & Commercial Establishment Act, 1958 it is hereby respectfully submitted that this Act of 1958 is applicable to UT Chandigarh, Punjab & Haryana. According to the process calendar you have shown the applicability in Haryana. According to the The Punjab Shops & Commercial Establishment Act, 1958 as applicable to the State of Haryana, it is not necessary that in every case a sum Rs.5000/- is to be deposited. We are neither to maintain any contributory register nor we are to deduct any contribution under this Act. The details of contribution as shown by you are to be sent to Welfare Commissioner, Haryana under the Punjab Labour Welfare Fund Act, 1965 as applicable to the State of Haryana if applicable to the establishment. We are also not to send any quarterly returns under this Act as shown in your process calendar. It is also submitted that we are not to submit Form ‘G’ annually/quarterly.
Opinion/comments submitted after going through The Punjab Shops Act, 1958 & The Punjab Labour Welfare Fund act, 1965. Comments of other members are also invited.

Dear Sir,

Yes, it applies in Haryana.

It is not necessary to deposit INR 5,000/- in all cases. It depends on the number of employees. If it is less than 10, then there is no need to deposit the money at the time of registration. However, we should fulfill the registration formalities under the Haryana Labour Welfare Fund and also maintain the employee-wise records as per the act. Additionally, submit the quarterly return accordingly.

Dear,

It is again made clear that we are to deposit the fees even if we do not employ a single employee in the establishment such as in cases of starred hotels, petrol pumps, banks, finance companies, etc. In this category, the registration and renewal fees are Rs.10,000/-. For more details, one should go through the fees chart as laid down in Rule 13(1) of The Punjab Shops and Commercial Establishment Rules, 1958, as applicable to the State of Haryana. This fees chart was substituted by Haryana Govt. notification No. GSR-1/32/82-1Lab dated 28.02.1997. Fees are for a block of three years. Year means a year commencing on the 1st day of April.

Dear All,

We have registered under The Punjab Shop & Commercial Establishment Act for the financial year 2007-2008. However, due to some reason, we have not renewed the registration for the financial year 2008-09. Please suggest what to do in this case.

Hi,

We have a store in Zirakpur, Punjab. We have already obtained the Shops & Establishment Certificate. The authorities have informed us that there is no need to renew it for the year 2010 as the renewal process has been halted for this year. Kindly advise us on this matter.

ER-1 & ER-2 are returns of Regional Employment Exchange Returns which are to be filled on a half-year and yearly basis. Via these returns, you are to inform the Employment Exchange about any leaving or joining of employees if the percentage is more than 5%. If not 5%, then a return for Nil joining or leaving is to be provided.
