I m working in ophthalmic lens company ( the join venture partner(50%) with world best lens company ) as Asst manager –HR
From august 2007 but now management gave me 2 option ether I have to change my dept or give resignation or they will give me termination letter than I refuse to change my dept now they want my resignation without any specify reason . and my aerials and medical & LT still pending with company but I don’t think now they will ready to give me and still I dint get my confirmation letter and one more thing I sign one agreement for 4 yrs.
Kindly guide me for the above .

Dear Rekha,
You are not alone in this situation.
Please go through the agreement to determine whether it is at the sole discretion of the management to terminate the job before completion of the period without prior intimation/notice. If this is the case, then you cannot do anything except submit your resignation.
If you are diligent in your work, then the management has no right to terminate your job without giving prior notice. Please address the management in writing using a polite language regarding the agreement clause and request any pending dues if necessary.
However, please carefully consider before leaving the job because if you switch departments, there is a possibility that you may relocate to your previous position in the near future.
Also, make sure to obtain a confirmation letter when you join any organization in the future; otherwise, you will not have any safeguard for the future.

Please refer to the agreement you signed, i.e., the exit clause in the agreement. Is your employer complying with the requirements as per the agreement?
One thing I am not clear about is your role as Assistant Manager HR for almost 2 years. Your superiors or management should have trust in you to the extent of giving the reason for transferring you to another department or asking you to leave. When your management says there is a change in department, which department do they want you to transfer to? I suggest making a change in department and then start looking for a good job in HR. You may find it difficult to get a job if you are unemployed. Also, you never know, you may even enjoy the new department or new job role.
Also, why did you sign a 4-year contract? It is the most stupid thing I have ever heard of. Anyways, never repeat this mistake in the future.

I would suggest that you change the department for now to save your job and to receive the pending payments. As an HR professional, you should be thorough with the exit formalities. Next, look for a better opportunity, and next time, it's better to avoid contractual assignments.

Changing department is not the solution because you have been working as an Assistant Manager for 2 years. Suddenly changing your profile could make it difficult for you in the future. Please understand the current situation and negotiate with the management until you secure another job. Also, try to identify the reasons for this move and update yourself accordingly.
