Legal Requirement for PAN Amendment
Rule 114 of the Income Tax Rules, 1962: This rule outlines the procedures for PAN issuance and amendments. When there is a change in the constitution of an entity, it effectively alters the legal identity under which the PAN was originally issued. Therefore, a new PAN must be applied for under the new entity structure.
GST Registration Implications: According to GST regulations, any change in the constitution of a business also leads to a change in the PAN. Since GSTIN (Goods and Services Tax Identification Number) is linked to PAN, any alteration in the entity's structure requires cancellation of the existing GST registration and application for a new one based on the new PAN26.
Documentation: To amend the PAN card following a change in constitution, entities must submit a request using the designated form (Request for New PAN Card or Changes or Correction in PAN Data) along with supporting documents that validate the change, such as a certificate from the Registrar of Companies (RoC) for name changes or changes in business structure47.
