The Maternity Benefits Act does not specify any number of times a woman employee shall avail leave for a miscarriage. It is not a deliberate act. Therefore, every time a miscarriage happens, the employee should be given 45 days of paid leave each. At the same time, a miscarriage, the causing of which is punishable under the Indian Penal Code, will not come under the purview of a miscarriage under the Maternity Benefits Act.
