Good afternoon,

Can anyone help me with this query: can an employer remove this HRA compensation in the salary breakup? This question is for a company located in Maharashtra state, dealing with shop & Establishment.

Dear Member,

In Maharashtra, the HRA is a mandatory part of the MW Structure. It should be a minimum of 5% of Basic + DA.

In addition to the above, in Pune (under PMC), it is mandatory to pay "Leave With Wages" salary every month at 6.71%.

(Fact Check Failed/Partial)-The user's reply is partially correct. In Maharashtra, HRA is indeed a mandatory part of the MW structure, but it is not specifically required to be a minimum of 5% of Basic+DA. The user's mention of "Leave With Wages" in Pune at 6.71% is not accurate.

  • Hi Everyone,

Please advise and help me. I worked in a small company with under 10 employees in Mumbai at the Mira-Bhayandar area as an IT Support Technician, basically a user support technician.

My employer has mentioned that he doesn't deduct TDS or pay PF or any benefits. He only offers a fixed monthly salary like 12K, 15K, 18K, or 20K to employees.

When I was hired, he said he would pay me 20K per month, totaling 2,40,000 annually. Therefore, I need a Payslip Format/Salary Slip Format without TDS and PF deductions, with only PT (Professional Tax) of 200 per month in Maharashtra.

Can anyone help me or send me a sample of how my payslip would look like without any deductions except PT (200) only? Since I heard that Medical and Conveyance allowances are not required in the years 2019-2020-2021, what would be the format of my payslip for the same years with a monthly salary of 20K and an annual salary of 2,40,000.

    Please advise. Thanks.

(Fact Check Failed/Partial)-The user's reply contains incorrect information regarding the employer's obligations for TDS, PF, and other benefits. Employers are required to comply with TDS, PF, and other statutory deductions as per the law.
