If the establishment is covered under EPF, then they have to offer all labor welfare facilities in a uniform practice to all employees. However, if the employee:
1) does not have any active UAN or membership from past service/s
2) does not want to participate in EPF
then they have to submit Form 11 with a request letter stating their choice of not participating in EPF. The employer has no choice to exclude or include. Additionally, if the member has any past record of EPF relations, then they would not be exempt from contributions.

As per EPF Scheme, Para 69, (5) - Any member who withdraws the amount due to him under subparagraph (2) shall, on obtaining re-employment in a [factory or other establishment] to which the Scheme applies, be required to qualify again for the membership of the Fund. On qualifying for membership, the member shall be treated as a fresh member thereof.

Thank you for your response. I am seeking information about EPS. I have been informed that in the case of a new employee whose salary exceeds Rs. 15,000, they "should be" exempted from EPS. Could you please clarify this for me? It would be greatly appreciated if you could also attach any circular related to this issue.
