Can anyone suggest a format for following
a legal declaration form from new employees stating that they don't want to opt for organization's on roll terms of service rather they would like to be considered as consultant.

What is indicating from the post is that the employer is interested to recruit employee as consultant not as employee. The employee will do full time work like regular employees but no PF, ESIC etc. deduction.

This is absolutely illegal even after taking declaration from employee that they will work in the status of consultant but not as regular employee. This is just by-passing law to avoid PF, ESIC, Gratuity, Bonus etc.
