Can anyone suggest a format for a legal declaration form for new employees stating that they do not want to opt for the organization's on-roll terms of service, but rather, they would like to be considered as a consultant.

What is indicated from the post is that the employer is interested in recruiting an employee as a consultant, not as an employee. The employee will be doing full-time work like regular employees but without PF, ESIC, etc. deductions.
This is absolutely illegal, even after obtaining a declaration from the employee that they will work in the status of a consultant, not as a regular employee. This is simply bypassing the law to avoid PF, ESIC, Gratuity, Bonus, etc.
