This is purely based on the terms and conditions of appointment. The alleged 5-year commitment to work for 5 years is based on an agreement or only verbal.

If a 5-year commitment is by an agreement in writing, please check the clause that the five-year period should be after the successful completion of the probation period, mostly. If the clause says it is from the day of probation, then the question of fixing the probation one-year period is meaningless, and the same can be challenged. The total agreement is one-sided and void. Consult an advocate.
