One of my friends, who worked as an assistant professor in college, was terminated last week without notice period. He had completed one year of service there. There was no salary for him during the vacation period. After rejoining in June, he was called to the office of the chairman and told not to come for the job from the next day onward without any reason. He was not properly compensated.

In general, they should not discontinue in this unethical way for a person who is in a respectable role - a Professor. However, one needs to understand the issue from the other side as well. It is important to check the terms and conditions of the employment.

Your friend was told verbally, so you cannot move for a legal fight. However, your friend can lodge a complaint of non-payment of wages before the labor department. Once the proceedings start under the payment of wages, everything shall be clarified. In my opinion, contact a lawyer specializing in labor matters in Tribunals and High Courts for future course of action.

Before approaching the labor department, verify whether educational institutions in the state are covered by the Payment of Wages Act 1936. Usually, they are not. Furthermore, if the monthly wage of the employee is above Rs. 24,000, the labor officer is helpless under the POW Act.
