I have placed a new thread Labour Law Basics which is the synopsis of all the Acts. It is really further easy and important sections are compressed. Make use of it.

I want expert advice on the following query:
X Employee is getting a salary as under, for example:
Basic 37625
Allowances:
Petrol 9622
Car Allowance 7500
Car Maintenance 1500
Medical 3760
Special Allowance 5000
PF Cont. 4515
Gratuity 1567
LTA 3135
Misc 1000
In total, CTC works out to be Rs.9.02 Lacs based on the above. The Company wants to give HRA as well as a Bonus to the extent of 40% of the basic and a fixed bonus of Rs. 2000.00 PM.
The Company states that the Special Allowance will be withdrawn, and Car petrol will be considered based on actual usage, which is between Rs. 6000 to Rs. 7000 PM for calculating the new CTC. My question is how they can withdraw the special allowance given to the employee over the years and base petrol expenses on actual usage rather than the entitlement of the employee. Under this arrangement, the increase will be Rs.1.04 Lacs instead of the promised Rs.2 Lacs due to the non-consideration of actual entitlement and the withdrawal of the special allowance.

Dear Mr. Jaspal Anand,
The company has the right to withdraw any benefits and special allowances given to its employees. They cannot reduce your Basic Salary or DA. However, other allowances can be curtailed, withdrawn, reduced, or enhanced at the discretion of Management and the financial conditions of the company.
